Acknowledging the limitations of its domestic labour market, particularly for skilled professionals, Luxembourg is broadening its hiring criteria.

Effective 1 September 2023, a new law simplifying the hiring of skilled workers has come into effect, with a focus on sectors such as IT, health, engineering, finance, business support, and certain building trades. The government highlights the pressing need to address labour shortages in these fields, with an eye towards maintaining competitiveness.

One significant change will be the simplification of access to the Luxembourg labour market for nationals from non-EU countries. Family members of third-country nationals holding Luxembourg residence permits through family reunification can now work in the country upon arrival, granting them unrestricted access to the labour market, according to the Ministries of Labour, Foreign Affairs, and the National Employment Agency (ADEM).

In addition, access to the labour market is made more accessible for individuals in specific categories, including applicants for international protection who have been in the process for six months. Also included are beneficiaries of deferral or suspension of expulsion applying for temporary occupation permits.’

ADEM has recently released a list of occupations in short supply. For positions listed, ADEM is exempted from the customary market test requirements, which involve checking the availability of job-seekers matching the employer’s sought profile. For all other job categories, the market test will be maintained but with shorter deadlines.
