A first ruling was made in a dispute between a private company and mayor.

A private company had written a letter to the municipality in July 2018, demanding the construction permit for an office building. Since no reply was issued before the end of the year, the company addressed the court of administration for assistance in the matter.

The administrative court recognised the appeal made by the company and thereby annulled the refusal of a construction permit, which had resulted out of the neglected answer on behalf of Ettelbruck mayor Jean-Paul Schaaf.

The respective issue needs to be brought back to the mayor's office, with the municipality forced to pay trail costs and 600 euros in damage repairs.

According to the first ruling in the matter, a mayor has to check the details of construction projects and approve permits in case of conformity. A refusal would not only be unlawful, but moreover represent an abuse of power of the mayoral office. The delayed answer is due to a planned reorganisation of traffic routes in the respective area. However, no concrete plans have yet been formulated for this undertaking.
