
A 27-year-old man appeared at the Luxembourg City court for forgery on Tuesday. After his employer refused to grant him a few days off, he promptly falsified a medical certificate in December 2016 in order to rest. Recognising a forgery, the company proceeded to file a complaint against the employee.
The prosecutor's representative requested a six-month suspended sentence and a reasonable fine. According to the prosecutor, the man was guilty of a foolish/big mistake rather than an actual crime, something he himself was aware of. The man had falsified a medical document, however the gravity of the case was relative.
According to a policewoman's statement, the accused had changed the date on a genuine medical letter. He had however admitted to his actions to both his doctor and his superior, and regretted his actions. After the pressure of work, excessive fatigue and his request being refused, he hadn’t fully considered the consequences of his actions.
The company's attorney requested €5,000 in damages and reimbursement of €2,050 in legal fees. The accused, in turn, stated that he understood the claim but challenged the amounts.
The judgment is set to fall on the 20 June.
