Health Commission New Covid law revised by MPs on Friday

MPs serving on the Health Commission have met to work on the amended text for the new Covid law, which will be voted on in the Chamber next week.

In addition to the CovidCheck certificate, another certificate will be made available for people who cannot be vaccinated due to medical reasons. People who have a medical exemption will also be permitted to carry out rapid Covid tests on-site, a measure which is also planned for hospitality staff.

The text has also been reworked using the advice given by the National Commission for Data Protection (CNPD), which recommended voluntary registration for a list of all citizens who have been vaccinated or who have recovered from the virus, to facilitate the CovidCheck system in different places. The law will underline that appearing on the list is voluntary and a person’s name can be removed at any time if requested. The contents of the list would be deleted following the expiration of the law.

In addition, the refusal to register should have no impact on a person’s ability to work, according to the text. An employee’s choice whether or not to present their CovidCheck at work should be respected and must not have a negative impact on their work.

The CNPD did raise some concerns over whether such a list would prove useful, for example in a restaurant or company setting, or whether it would be easier to simply scan a QR code as is currently the case.

In addition, the government has revised the paragraph in the text which pertains to vaccinations and pharmacies, after the Council of State raised a number of legal ambiguities. The new text specifies that a pharmacist may vaccinate persons over 16 years of age and without a medical prescription, provided that they undergo specific training.

According to the rapporteur of the Covid law, Mars di Bartolomeo, the next Covid law will be voted in the Chamber on Thursday next week. There may also be a vote on Friday.
