According to our source, the employee is now at risk of losing her job.

The CovidCheck regime has been in place in hospitals since June, meaning that anyone entering must show they are vaccinated, recovered or tested. There are free rapid tests available for this; staff must get tested three times a week.

But one care assistant refused to get tested and had not been at work since, HRS spokesperson Marc Glesener said to RTL. He also confirmed the legal dispute.

He stressed that this was an isolated case. After all, hospitals were at the centre of the fight against the pandemic and their main aim was to protect the health of patients and staff. It was important to underline that this had nothing to do with mandatory vaccination.

Asked whether it was possible to give the person unpaid leave, he said this was a political decision, as this would need to be regulated in employment law. There were no such provisions in the Luxembourg Covid law.

The HRS groups employs around 2,250 people, including 300 doctors. 1,500 people are in direct contact with patients, including the person embroiled in the legal dispute. 89 percent of their staff are vaccinated.
