
In addition to the custodial sentence, the prosecution requested a fine and a 2.5 year driving ban for the now 40 year old man.
In 2016, the defendant had knocked over an 83 year old pedestrian on a zebra crossing - the victim died five days later. At the time of the accident, the defendant had a blood alcohol content level of 0.240.
The coroner saw a clear connection between the accident and the death of the victim, who had required CPR in situ and was brought to a hospital.
At the hospital, they discovered the fracture of a cervical vertebra and bleeding of the brain.
A witness, who who was in the passenger seat at the time, had told the driver to be careful. He is said to have seen the man crossing the road from at least 25 metres away and alerted the driver.
The elderly man had been crossing the road very slowly but still the driver did not see nor allow for the possibility of a collision and hit the victim. The witness said that he had heard the sound of heavy braking and a loud thud at the same time.
According to the judge, the defendant was unable to explain the circumstances properly at the time due to the 'high alcohol level' consumed.
The president of the court told the defendant that it was obvious that something like that would happen if '10 to 15 beers' have been consumed. To this the defendant said that he was 'sorry'.
After Ms. Tecqmenne (prosecutor) asked for roughly €30,750 in compensation for the nephew of the victim, the defendant's lawyer explained that her client knows that taking the car that night was a mistake but he had not seen the elderly man. According to Ms. Wieclawski there was no excessive speed involved and that due to mitigating circumstances, there should not be a prison sentence.
The representative of the court disagreed and said that getting into a car that night was the defendant's biggest mistake and that it was a very sad case indeed.
The verdict is scheduled for 20 May.
