The dispute reportedly arose from Georges’ management style, which the Administrative Board deemed overly focused on a corporate approach, rather than prioritising ProActif’s role as a social initiative aimed at integrating individuals with various challenges into the primary labour market.
The disagreement between Georges and Conter allegedly escalated to the point of near physical altercations, ultimately resulting in Georges’ dismissal.
The judge was tasked with determining whether the President’s dismissal of the Director adhered to legal standards regarding procedure and justification. As already mentioned, the director’s requests were deemed inadmissible.
It is worth noting that summary proceedings are intended for cases requiring urgent legal resolution.
Georges’ dismissal is set to take effect in mid-April, prompting him to register with the National Employment Agency (ADEM) for unemployment benefits. Notably, the appeal in summary proceedings does not preclude the possibility of further, and more in-depth, legal proceedings in the future.
The judge’s ruling in summary proceedings is provisional and subject to appeal within a two-week period.
In a related development, another governance dispute is set to be adjudicated through summary proceedings next week. The ousted President of the Administrative Board of the Mutualist Medical and Supplementary Fund (CMCM) is contesting his removal, alleging a breach of the organisation’s Articles of Association.
