Businessmen Gérard Lopez and Eric Lux, together with two former board members of the Esch football club Fola, will face trial in December in connection with a long-running financial investigation. The trial, which follows years of legal wrangling, concerns allegations dating back to 2014 involving a substantial financial transaction between the Formula 1 team Lotus and Fola Esch. Gérard Lopez, president of Lotus from 2009 to 2015, was also heading Fola at the time.
The case began after a commission from the Luxembourg Football Federation filed a complaint with the public prosecutor's office. Auditors from PwC had flagged a suspicious donation worth millions from the Formula 1 team to Fola. The football club subsequently transferred the funds to Gérard Lopez and a company owned by Eric Lux in Hong Kong. The nature of any services or consideration provided in return remains unclear in both instances. All those implicated have consistently denied the accusations.
The legal process has been marked by extensive appeals, with defence lawyers taking the case as far as the Court of Cassation to contest the charges. However, this final appeal was rejected at the end of May, clearing the way for the trial to proceed. The trial is scheduled to begin in mid-December at the correctional chamber, with three sessions planned.
As with all criminal proceedings, the presumption of innocence applies until a verdict is reached.
