Henri Kox explained that clients cannot be forced to sign amendments to their contracts and/or cover additional costs before the construction project resumes.

Construction firms are nevertheless at liberty to increase prices if the original contract that was signed by the client before the pandemic allows for it. Kox stressed that Luxembourg's legislature protects clients against pressure from construction companies.

As we reported in an earlier article, a Luxembourg-based construction company sent various contract amendments to its clients.

One of the key amendments: additional costs of up to €30,000 to cover "health security measures." The firm reportedly invoked a Grand Ducal decree from 17 April to legitimise the added expenses and told its clients that construction works would only resume once the staggering amount has been paid.

The consumer association (ULC) then reacted by stating that "additional expenses for sanitary measures" should not be paid by the clients. ULC stressed that budding homeowners should not sign amended contracts - a position that was now reiterated by the Minister of Housing.
