
In April, the state court had come to the decision that a young woman would have to pay a total amount of €65,000 to three plaintiffs, a sum with which the wife, son and daughter of the victim were unsatisfied with.
Since the first judges had not come close to the sum of the individual demands - which amounted up to €315,000 in damages - they appealed the first sentence.
Their lawyer, Rosario Grasso, was of the opinion that the amounts conceded - €25,000 for the victim's wife and €20,000 for each of the children - were insufficient and should be increased. Grasso pointed out that while this might be sufficient to compensate for mental distress, it was lacking when it came to material damages, as the victim had been the main breadwinner as well as caretaker.
While the defendant was not present at court on Friday, her lawyer, Mathieu Fettig, agreed that the family had doubtlessly suffered losses, however their demands had to remain within reason. While he did not contest the damages claimed on mental and emotional grounds, he would challenge the material ones.
The appellate judgement will fall on the 19 November.
Half a year ago, the accused was condemned to six months suspended sentence, a €1,500 fine, and a 24 month long driving ban (18 months of which are suspended).
Nearly three years ago, the woman had hit the 77 year-old victim on the zebra crossing outside of Cactus-Howald, who died from his injuries 5 days later.
