A municipal employee dismissed without notice last December has suffered a setback in court as the judge ruled against the overturning of his dismissal – leading the employee to appeal.
The legal battle in Contern regarding the dismissal of a long-standing municipal employee remains in the balance.
In December, the municipal employee, whose career spanned 28 years, was dismissed without notice. A few months prior to the termination of his contract, the employee had lodged a complaint alleging workplace harassment.
Last Friday, the labour court did not overturn the employee's dismissal. The employee's lawyer, Alex Penning, argued that his client's dismissal had been invalid according to labour law. However, the judge handling the case did not agree.
Following this setback, Mr. Penning confirmed that they will appeal. Furthermore, Mr. Penning made clear his intention to submit a petition to the labour court and demand compensation for his client. The next round of the legal battle will take place next Monday.
There have been allegations of bullying and of a "toxic work environment" in Contern surfacing since last year. Furthermore, an employee representative of the municipality was suspended around the same time as the aforementioned employee's dismissal.
