In a recent interview with our colleagues from RTL Radio, LSAP MP Paulette Lenert expressed her unequivocal stance on the contentious begging ban, emphasising its lack of a legal basis.
Lenert, drawing on the precedent set by the courts, stated: "It's not a question of discussing what we think - the courts have spoken." She emphasised the need to respect established case law on the matter, stressing that the justice system's decisions must be adhered to.
Addressing Minister for Home Affairs Léon Gloden's differing opinion on the matter, Lenert expressed concern, stating that it is worrisome to "openly and casually" oppose the justice system. "Citizens are expected to respect the courts. Political institutions must lead by example," Lenert said, asserting, "If the majority do not agree with the courts, they have the option to change the regulations by law."
"Frightened by the tenacity" with which the debate has been conducted
Expressing dismay at the "tenacity" of the discussions surrounding the begging ban, Lenert criticised the lack of honesty in the debate. While acknowledging the need to combat organised begging, she highlighted that existing legislation already addresses this issue. However, Lenert stressed that politicians cannot dictate instructions to the police, as this falls under the jurisdiction of the public prosecutor's office.
A joint meeting of the Justice and Home Affairs Committees, with the participation of relevant ministers and the public prosecutor, is scheduled for Tuesday afternoon. Lenert hopes for government support in upholding the rule of law, advocating for legislation to facilitate a "transparent and honest" debate.
Will Lenert stand in the European elections?
The interview also touched on the possibility of Lenert standing in the European elections in June. While no decision has been made yet, Lenert affirmed that, with or without her, the Luxembourg Socialist Workers' Party (LSAP) aims to present a strong list. At the national level, Lenert stressed the LSAP's responsibility in providing effective and honest opposition.
