After repeatedly failing to tackle the Luxembourg City council's decision to hire a private security firm, the Left has come out in favour of new legislation that would give councillors greater power to go up against the Minister for Home Affairs in court.

Last year, Luxembourg City councillors from the Left appealed a first-instance ruling and take stance against the aldermen council’s decision to employ a private security firm in the capital.

The party had argued that private companies are not allowed to take over public works, but the Administrative Court declared this position inadmissible, ruling that elected representatives had no “interest in acting” against a decision by the municipal executive as they had not been personally affected by the decision.

The party’s subsequent appeal was rejected by a new ruling on 13 July 2023, which upheld the initial decision.

The Left has now issued a statement (FR) to come out in favour of new legislation to give municipal councillors the power of taking such issues to court in the case of “inaction” on the part of the Minister for Home Affairs. The statement argues that “such a system would be both more respectful of communal autonomy and the rule of law”.
