The judgement on 10 February, which has now been made public, confirmed Félix Braz’s forced resignation as a minister would stand. After the former Green politician was hospitalised for months following a heart attack on 22 August 2019, Prime Minister Xavier Bettel granted Braz an “honourable resignation” in October 2019.

A year and a half later, Braz lodged an appeal against this procedure, explaining he had not requested the resignation. The court, however, ruled that the Prime Minister’s decision could not be reversed. The action brought by Braz claiming discriminatory compensation was also dismissed. Lawyers acting on behalf of the State argued that a ministerial dismissal did not fall within a court’s jurisdiction

Two years ago, the LSAP MP Yves Cruchten commented that Braz’s case was proof that the current laws needed to be adapted.

Braz later told reporter.lu that he intends to appeal the decision.
