COPAS, the umbrella organisation of care providers in Luxembourg, stated that it does not agree with the current text of the new Covid-19 law, which has to be passed by MPs until Saturday at the latest.

Luxembourg’s care providers criticise a number of the draft bill’s sections, most notably the obligation for staff to be tested twice a week. COPAS states that external staff members, visitors, and people working in the institutions themselves should not be subject to different treatment.

Everybody should have to take the same type of test, the organisation demands, i.e. either a PCR or rapid antigen test. Healthcare professionals should not be treated differently, according to COPAS.

COPAS also questions whether the new Covid-19 law could potentially undermine staff members’ right to privacy since they will technically have to disclose to their employer whether they are vaccinated or not, should they refuse to take the mandatory test. The organisation argues that this particular point should be specifically mentioned in the new law.

In addition, COPAS criticises the fact that an employer can remove an employee from their post, should they refuse to get tested.

The organisation wonders who would cover the costs to replace this person and whether the state would cover the fees. On top of that, COPAS points out, this measure could negatively affect the organisation within the structures themselves.
