On Thursday, Minister for Home Affairs Léon Gloden announced in the Chamber of Deputies that the government plans to file a formal complaint with the European Commission in response to Germany’s decision to extend its border controls for another six months.

The Luxembourg Socialist Workers’ Party (LSAP) and the Green Party (Déi Gréng) submitted a joint motion urging the government to take stronger action by challenging the border controls in court. Specifically, the opposition parties called for a lawsuit to be filed with the European Court of Justice.

However, Minister Gloden expressed scepticism about the effectiveness of such a legal challenge. He noted that it could take over three years for the case to be debated and a verdict reached, making it an impractical solution in the short term.

Gloden also highlighted that the Schengen Code allows border controls to be maintained for a maximum of three years under exceptional circumstances. The opposition’s motion was ultimately rejected, with 40 votes against and 20 in favour.
