Administrative CourtProperty tax increase in Diekirch once again ruled unlawful

RTL Today
In 2020, the Diekirch municipal council made the decision to significantly raise property taxes on fallow building land, specifically targeting category B6 plots.

The proposed tax hike aimed to elevate the rate from 750% to a staggering 15,000%, drawing objections from numerous residents who deemed the increase excessive.

In response, a formal complaint was filed, leading to a favourable ruling for the plaintiffs in the initial court proceedings. However, the local authority contested this decision on appeal.

The Administrative Court recently delivered its judgment in the second instance, once again siding with the citizens and nullifying the proposed tax increase put forth by the municipal authorities. The judges deemed the measure disproportionate in both rulings.

During a meeting on Thursday, the Diekirch municipal council opted for a new property tax rate of 1,500%. The councillors of the Luxembourg Socialist Workers’ Party (LSAP) voted against this revised rate.
