
Around 23,000 users have clearly signalled their refusal to join the organ donation register, while for 70,600 people, there is an automatic agreement within the DSP.
This means these users have not specified their wishes in terms of organ donation.
Minister of Health Martine Deprez provided these figures in response to a parliamentary question.
By law, every Luxembourg resident is potentially considered as an organ donor, unless they have specified in writing that they do not wish to donate organs. The Ministry of Health supplied the following statement:
Since 25 November 1982, the Grand Duchy of Luxembourg has had a law on the removal of human organs and tissues. It was published in the Memorial A journal on 3 December 1982. According to this law, every resident of the Grand Duchy is a potential organ donor, meaning that organs and tissues may be removed after the death of any person who had their last legal residence in Luxembourg and who did not, during their lifetime, make known in writing their refusal to such removal. There is therefore a presumption of solidarity by which it is considered that, without opposition during their lifetime, each person agrees to donate their organs after their death.
