Contributions skipped during marriage18 divorcees have "bought back" their pension rights

The divorce law of 2018 allows people to retroactively buy back their pension rights after a divorce.

Barely anyone seems to be aware of this offer, however. Only 18 people have made use of it in the past two years. They have reconstituted an entire pension career for themselves, because they had stopped paying contributions during their marriage. A total of just under 1.5 million Euro were transferred cumulatively for the 18 cases.

Looking at the number of divorces in the country, this measure is virtually unused. Luxembourg district reported over 1300 divorces between 2018 an 2020.

This information was disclosed by ministers Sam Tanson and Claude Haagen as a response to a parliamentary question by LSAP Deputéierte Mars Di Bartolomeo.

The government is planning to look into how a new divorce law could allow more people to benefit from a retroactive buy back of their pension rights.
