MP Sven Clement from the Pirate Party recently filed a parliamentary enquiry concerned with the digitalisation of tax cards and the potential fines that businesses face for failing to complete the procedure.

The digitalisation procedure of tax cards was launched in 2021, allowing employers and the pension fund to directly view tax cards online. Since 1 January 2022, it has become mandatory for businesses to use the mechanism.

In his enquiry, MP Clement thus wanted to know how many businesses have already been fined for failing to complete the digitalisation procedure, as well as the amount that they have to pay.

In her response to the enquiry (LUX), Minister of Finance Yuriko Backes conveyed that 1,880 businesses received a fine for not having downloaded their employees’ tax cards from MyGuichet.lu by the beginning of May.

According to the Ministry of Finance, the majority of those are businesses with fewer than 50 employees, which may face a maximum fine of €800. Larger businesses that fail to complete the procedure may face fines of up to €10,000.

Minister Backes also conveyed that fines may still increase if businesses fail to download the tax cards after the first penalty.
