
The man is being prosecuted for filming the interior of a women's changing room in Esch with his mobile phone in February 2015. At the time, he allegedly climbed onto the roof of the sports hall to film female basketball players. During a house search, two other videos, and a photograph of the women's toilets at a children's playground, from November 2013 and February 2014, were also discovered.
The president of the court inquired as to how the idea of climbing onto the roof of a sports hall, or going into the women's toilets at a children's playground to record video, came to the offender's mind. The perpetrator acknowledged the facts from the outset and stated that he deeply regretted them.
In February 2015, a basketball player told the caretaker at Esch sports centre to report that she had observed something unusual on the roof. The caretaker went to check and found the accused, and threatened to call the police. The man tried to run away, but the witnesses held him down until the police arrived.
The doorman also noticed that the defendant's zip was open. This prompted the deputy to ask whether the man had masturbated. Hesitantly, he answered "yes".
A police officer, who had been tasked with searching the accused's home in March 2016, explained that the material had been examined. Two videos were discovered: one of a woman, and another of a six- to eight-year-old girl. According to a psychiatrist, the man had explained that his voyeuristic behaviour had developed after a divorce, but he did not suffer from any mental illnesses.
The defense lawyer, Mr Bellwald, stated that his client went to a psychiatrist for treatment on his own initiative in 2016. This was a positive element that the representative of the public prosecutor's office took into account, as well as the fact that the accused is a first-time offender.
The representative of the public prosecutor's office, however, stressed the perversity of the accused's actions. It is for this reason that the prosecutor requested a prison sentence of 18 months, with a possible probationary period and, for judicial coercion, another follow-up. He also requested a fine and the confiscation of certain objects, including the smartphone.
The court will render its verdict on 22 October.
