
The request was denied because the grounds given - educational needs - did not fulfil the requirements as per the amended law of 25 May 2011 relating to the hunt. Article 34 of this law sets out under which circumstances a hunting lot can be rented out. These amendments were made "for reasons of general interest" and decree that the State and municipalities "may hire out in their name and at their expense one or more hunting lots" so long as the proceedings are regulated by the minister, municipal council or the board of the mayor and aldermen.
Bill 5888 repeatedly underlines that, in order to rent out a hunting lot, the grounds given must be of exceptional nature, such as:
- public security;
- close proximity of an urban area;
- "sensitive" hunting lots including an airport, a marshalling yard, a motorway belt, etc.
The law helps prevent potential conflict between particular individuals and hunters by regulating the renting of huntings lots and the practice of hunting in general.
