While it has not formulated any major objections to the text, the Council of State has proposed a slight adjustment to the definition of a terrace.

The Council of State proposes an amended definition, which includes slightly different wording and omits a part of the original definition, which the Council deemed superfluous. The new text proposed by the Council defines a terrace as “a space which is located outside and in the fresh air, completely open on at least three sides”. The Council also points out that inner courtyards would not be covered by this definition.

Overall, the Council of State has not formulated any major objections to the draft bill. It only pointed out that lawmakers should potentially clarify what they mean by an establishment able to host musical events. Measures are to be relaxed in that area, particularly pertaining to the mandatory distance and the obligation to wear masks. The Council wonders whether it would be enough for someone to put a few chairs in a room to fall under the current definition.

The Consultative Commission on Human Rights (CCDH) has also assessed the text and pointed out once again that the government is imposing restrictive measures which are partly only regulated by directives. The CCDH also doubts whether the proposed definition is clear enough and criticises that the new rules applying to music lessons raise too many questions.
