The two organisers of the demonstrations against the Covid-19 measures in Luxembourg City, Jean-Marie Jacoby and Peter Freitag, had their first appearance before a Justice of the Peace in Luxembourg City on Tuesday morning.

The two men are accused of not having respected the sanitary measures in force during the demonstrations, such as the obligation to wear face masks or physical distancing. They are also accused of having used technical equipment to amplify speeches and play music, which is in violation of the regulations of the municipality of Luxembourg City.

The two defendants did not deny the facts but explained that they had not worn masks because this was the main message of the protests. They also explained that the lack of contact with other people would "harm" their immune system.
In their view, maintaining these measures violates the right to health. Jacoby also added that wearing a mask leads to the body "not getting enough oxygen" and that this measure should be considered as "an experiment on the population".

The two defendants stated that while the criminal justice system is able to determine whether the Covid-19 health measures were respected, it is unable to judge whether they were justified and legal. For this reason, the two defendants have requested the intervention of the Constitutional Court in this case.

The defendants are asking for an acquittal while the prosecution demands a fine. The verdict is expected on 1 March.
