Google data centre in BissenMouvement écologique 'disappointed' by administrative court ruling

In its second ruling, the Administrative Court recently confirmed that the Ministry of the Economy has no obligation to publish the Memorandum of Understanding with Google.

On Thursday, the non-profit Mouvement écologique (Mouvéco) stated that it was "disappointed" by the court's decision. The organisation's president, Blanche Weber, stressed that they would not let this case go, however. For Mouvéco, this case is about more than "just the data centre".

The environmental organisation called upon the government and the Chamber of Deputies to draw the necessary consequences from this ruling. Mouvéco criticised Luxembourg's legal situation, stating that Wednesday's verdict once again confirmed that the country lacked a legal definition of what an "administrative document" actually is.

The non-profit stressed that the entire case fell apart because of the definition of what falls under the term "administrative document". Compared to other countries, Luxembourg has a lot of catching up to do, in the eyes of Mouvéco, which pointed out that other countries first of all prioritised and regulated the right to information and then the nature of an administrative document.

It is "absurd and completely out-of-date" that Luxembourg lawmakers did not define this clearly in the law regulating the access to documents, Weber stressed and added that the same is true for the country's environmental legislation, which does not meet the current challenges posed by scarce ressources.
