The owner of the Café Waldhaff has lost the legal battle over the restaurant's terrace, which is now being removed after the courts ruled that the building must return to its original form.

Marc Hobscheit, the owner of the Café Waldhaff has lost a further battle in the legal fight to maintain the terrace of the restaurant. The restauranteur and the organisation have lost both the ruling in the Court of Appeals and the Court of Cassation.

Hobscheit had disagreed with the appeal verdict, in which he was subject to a €10,000 fine and ordered to return the building to its original condition within a year. Every month that this was delayed, he would be fined a further €7,500. The appeal verdict however did rule that Hobscheit would not have to close the restaurant down.

The Court of Cassation ruling has remained with the verdict that Hobscheit must return the building to its original condition, which means the terrace must go. Work is currently underway.
