In courtTraversini's appeal little chance of success, €2,000 fine remains

Former Differdange mayor Roberto Traversini, accused of violating laws on communal planning and issuing non-compliant building permits, will have little luck in his appeal to circumvent a €2,000 fine slapped on him in November 2019.

This is according to a source at the court. 
Traversini had issued a building permit in November 2015 for a large residence in close proximity to the couple's home. The municipality's technical department assured them that distance between homes would be respected, but as the stories grew the new building blocked out all the sunshine.

The couple turned on the town council in March 2017, with Traversini promising them he would contact the company in charge of construction and have them speak to the couple. The company proposed alternative arrangements, which the couple did not agree with.

In court, the couple argued that a new building would require 3 meter lateral distance, but that in reality it was only 1,65m. Traversini, for his part, stated that he had trusted the report of the building commission, as he issued the permit. The judge ruled that the 3 meter distance had not been respected with the new residence.

Accordingly, Traversini had violated articles of the 2004 law on communal planning and articles of the PAG and the building regulations of the municipality of Differdange. The ex-mayor was fined €2,000, and an architect was called to quantify the couple's damage with regards to the loss of value of their home. Traversini appealed.

A second ruling is expected on 16 December.
