According to the CNS, any sick note not issued by a qualified medical professional will be promptly dismissed. These counterfeit documents are readily accessible through various online platforms, allowing individuals to obtain them without undergoing a medical evaluation. However, it is important to note that the CNS will not provide reimbursements for these unauthorised sick notes.

Additionally, employers will be notified if a fake sick note is detected. The use of such fraudulent documentation not only breaches labour regulations but may also result in legal repercussions from the CNS.

Penalties for falsification

This warning thus particularly pertains to individuals who attempt to falsify their own sick notes or enlist others to do so. Any tampering with the medical information section, whether by the policyholder or a third party, is strictly prohibited and carries consequences.

The penalties for such actions vary depending on the severity of the offence:

· Modifying data pertaining to a period of up to three days’ incapacity for work incurs a fine of €200, along with the invalidation of the sick note.

· Altering data for periods exceeding three days’ incapacity for work results in a fine of €500 and the invalidation of the sick note.

· Repeat offences, regardless of the duration involved, lead to a fine of €750 and the invalidation of the sick note.

While these fines may not appear particularly dissuasive, it is important to recognise the potential for legal action and the repercussions employers may impose once notified, CNS say.
