Last month, the European Commission filed a complaint against Luxembourg for not correctly following a directive on basic rights.

The directive, which sets out vital protections for individuals in custody, including the right to legal representation and communication rights during detention, was deemed to have not been implemented correctly or on time in Luxembourg.

In response to a parliamentary question filed by LSAP MP Dan Biancalana, Minister of Justice Elisabeth Margue wrote that bill 8326 was currently undergoing amendments following the Council of State’s report published last week. The bill foresees improvement in the flow of information for legal representatives of minors.
