Google data centres in BissenEcological Movement's Claim dismissed at first instance

On Monday, the administrative court in Luxembourg City ruled that in the case of Google's data centres in Bissen, the memorandum of understanding does not have to be communicated to the Ecological Movement.

The judges specified that the memorandum concluded between the Luxembourg State, the municipal authorities of Bissen, and Google concerning the possible establishment of two data centres was not an administrative document.

If it had been an administrative document, the memorandum would have had to be communicated to the Ecological Movement under the transparency bill from 2018. In their 32-page judgment, the judges also held that the document contained confidential information about Google's corporate strategy.

The administrative court therefore dismissed at first instance the Ecological Movement's claim that it wanted to be able to consult this memorandum of understanding in order to obtain additional information on the water consumption of the future data centres.
