
The Council of State said the new bill contains a proposal which does not respect the principle of the separation of powers, in particular the section which concerns the Minister of Education, Claude Meisch.
The wording of the text as it stands would therefore allow Meisch to override a government decision with regard to opening reception structures in the event of a temporary suspension of educational activity and care services.
The Council of State therefore proposed reformulating this section of the text, or omitting it entirely if it cannot be reformulated. Should either of the latter solutions take place, the text would be granted the green light by this authority.
Due to time constraints, it is thought that the section will be omitted.
The parliamentary health committee was scheduled to meet on Wednesday afternoon to discuss the bill 7768.
