The case revolves around the reclassification of the land development plan, signed by the municipality of Bissen on 20 June 2019.

This means that parties opposing the Google data centre just suffered another blow. Apart from their case against the Bissen municipality, Mouveco also contested the approbation undertaken by the Ministry for Home Affairs, as well as the Ministry for the Environment, Climate and Sustainable Development.

Another point of contention was the evaluation of the environmental report, which Mouveco believe has not been done properly. However, the ruling determined that this was not the case. Judges also argue that as an environmental organisation, Mouveco can only file lawsuits that relate to environmental protection laws.

Mouveco has not yet decided whether to appeal the decision or not. Upon enquiry, representatives noted that they will first consult with their legal advisers.

Why has construction not started yet?

While the court case revolves around the general land development plan (PAG), the Bissen municipality already approved the particular plan (PAP) back in October last year.

Nevertheless, construction of the data centre has not yet started, as there are still other authorisations that need to be filed and approved beforehand.
